ABILITY TO ENGAGE IN ART ACTIVITIES AND ASSUMPTION OF RISK:
Yetzirah activities include items but are not limited to sharp objects, razors, scissors, sharpies, pencil sharpeners, glues, pastels, pencils, wood, wood tools, plaster, ceramic tiles, clay, wire, fiber (yarn/fabric/papers), wax, fabric dye, and playing outdoor games. Yetzirah takes all possible precautions to reduce risk and provide safe, healthy, and enjoyable experiences. I warrant that my child is able to follow directions for all activities. I acknowledge that risks from participation in class activities exist and that I have allowed my child to attend art class/events knowing these risks and their possible consequences including personal injury as well as property damage and/or loss. I understand that making art can be messy, and agree that Yetzirah will not be responsible for stains, rips, or tears to participants clothing, or to the surrounding furniture or areas of the location where the activities are offered. I understand that any clothing that myself/minor wear may be subject to stains, damage, or contact with the materials or supplies used in the activities, and that Yetzirah will have no responsibility for damages thereto. I also take full responsibility for cleaning and treating such stains or damages to surrounding areas if I am hosting an event, as appropriate, and understand that Yetzirah will have no responsibility for damages thereto.
I understand that some individuals may have allergies or sensitivities to certain supplies or materials used by Yetzirah. Yetzirah may provide me with an ingredient list for materials used in the activities upon my request, and when it is feasible to do so, but cannot guarantee that there is no cross contamination or that there are no allergens present in its materials or supplies used to provide for the activities, or that other participants in the activities will bring or be contaminated with allergens. I understand that I will retain ultimate responsibility for ensuring that the materials or supplies provided by Yetzirah are safe for my use or the use of the minor(s), and I affirm that Yetzirah will have no responsibility for or liability with respect to allergies, sensitivities, or other injuries resulting from contact with the materials or supplies provided as part of the activities.
As a parent or guardian of my child, I agree that I will not hold Yetzirah liable for any personal injury, property damage or loss of insurance. I agree to release and hold harmless Yetzirah from all liability incurred as a result of my child’s participation in studio class and that these terms serve as a release for me, volunteers, property owners and members of my family. I understand that if I have any risk concerns, I shall discuss them completely with the staff before I sign this agreement and before beginning my/minor’s participation in the activity.
In the event of an emergency, I would like the participant to be taken to a hospital for medical treatment, if appropriate, or treated by an emergency medical technician, including but not limited to a trained member of Hatzalah of Baltimore, and I hold Yetzirah harmless in their execution of this action. Additionally, I hereby agree to indemnify Yetzirah against any costs that it may incur as a result of seeking such medical attention on behalf of myself/minor.
Knowing and understanding the risks involved with participation in the activity, I hereby voluntarily and willingly assume full and complete responsibility for all losses and damages, including injury, illness, and death, resulting from my/minor’s participation in the activity, including transportation to and from the activity. I agree I am financially responsible for any losses and damages resulting from my/minor’s participation in the activity.
In consideration for my/minor’s participation in the activity, I hereby waive all claims or causes of action, including ordinary negligence, against Yetzirah arising out of my/minor’s participation in the activity wherever, whenever or however the same may occur. All items left behind will be considered ownerless and disposed of according to Yetzirah’s discretion.
I understand that this waiver is intended to be as broad and as inclusive as permitted by the laws of the State of Maryland and agree that if any portion is held invalid, the remainder of the waiver will continue to be binding and in full legal force and effect. I agree that this waiver is in effect for any and all programs/sessions that myself/minor participate in. Yetzirah is committed to providing the agreed upon services. If services are not rendered, you will receive a refund. I agree that any matters of dispute would be dealt with by the arbitration of the Baltimore Bais Din.
I have read this form and fully understand that by consenting to this form, I am giving up legal rights and/or remedies which may be available to me/minor for the ordinary negligence of Yetzirah or any person listed above. I have read an understood this assumption of risk, waiver of liability and medical authorization and I voluntarily affix my name in agreement. I am the parent/ guardian of the child that I am registering for classes at Yetzirah. I affirm that I am of legal age and am freely consenting to this agreement for myself/minor.

PHOTO & VIDEO & INFORMATION RELEASE:
I grant consent for my/minor’s picture or their artwork’s picture to be taken or to be filmed while participating in all activities at Yetzirah Art, I authorize Yetzirah Art to use and publish images, photographs, pictures, portraits, and audio, video and/or film footage of myself /minor or my/minor’s artwork in all forms of media and in all manners for publication including, but not limited to, advertising and marketing campaigns, press releases, periodicals, social media, and website use. I agree that the artwork, along with my/minors name and information about the piece may be used and posted on the website, or for any marketing purposes. No compensation will be paid for such use. I hereby waive any right I may have to review, inspect, edit or approve such publication and I release Yetzirah Art its members, owner(s), managers, instructors, coaches, agents, employees, and Yosef Yaakov Markowitz (hereafter referred to as Yetzirah) from any claims I may have against it for use of such images, photographs, pictures, portraits, and audio, video and/or film footage of myself/minor or my/minor’s artwork. I consent to my/minor’s contact information, address, and demographic information being shared for carpool and other purposes.
